WEBSITE PRIVACY POLICY & TERMS OF USE (“Policy”)

The Southwest Indiana Association of REALTORS^®, Inc. (“SIAR”) Policy addresses the terms of use of our Website and explains how information is collected, how it is used, and how SIAR protects information gathered from our Website, www.swindianarealtors.com (“Website”) so that users are aware of the potential uses made of information collected as a result of utilizing our Website.

Privacy. Your continued use of the Website implies your acceptance of this Policy. Our Website gathers the following information from our users: (i) contact information that a user provides (i.e. personal or business address or phone number); and (ii) tracking information which our web server automatically recognizes each time a user visits our site or sends any communication to us (i.e. browser type and operating system being used by the visitor, pages visited, date and time of access). SIAR may use the information collected to do the following: (i) notify our users regarding updates to our Website; (ii) inform users of upcoming events, programs, and/or products or services that may be of interest to the user based upon information the user has provided to us; (iii) improve the layout or content on our Website; and/or (iv) to track the usage of our Website. SIAR uses the information collected for internal purposes only. SIAR does not disclose this information to any third parties and SIAR does not sell, share or trade user’s contact information, including but not limited to, user email addresses. SIAR may utilize users provided email addresses to send online informational or marketing materials as well as any other communications requested by users.

Security and User Privacy Expectations. SIAR has reasonable security measures in place to protect against the loss, misuse, and alteration of the information collected through our Website. However, as technology is ever changing, SIAR cannot guarantee that the information users transmit over the internet is completely secure. SIAR makes reasonable efforts to protect the privacy of our users, however, we cannot guarantee the security of information that users transmit over our Website and users transmit such information at their own risk. Each user agrees to hold SIAR harmless against any liability arising from the use of our Website.

Membership. Our Website offers both public access and “Members only” access. Certain portions of our Website and content therein may only be available to current members of SIAR. Users of the “Members only” section of our Website, if not already authenticated, will be prompted with a login screen. Any content retrieved from the “Members only” section of our Website is considered confidential and privileged information and shall not be shared with another party, unless such is permitted by the governing documents of SIAR. Members are responsible for keeping their username and password to their “Members only” account confidential and such Members are responsible for any and all activity that occurs under their account. Members agree to notify SIAR immediately of any unauthorized activity or misuse of their account or our Website. SIAR Members are reminded that their use of our Website is bound not only by this Policy but also by the governing documents of SIAR, including but not limited to, the Southwest Indiana Association of REALTORS^® Multiple Listing Service Corporation’s Rules and Regulations.

Transactions. Our Website uses the REALTORS^® Electronic Commerce Network (“E-Commerce Network”). When users access our Website to make payments by credit card or debit card (collectively “credit card”) or electronic check through the E-Commerce Network for products, dues, or services, the credit information that the user and credit authorizers provide including, but not limited to, credit card number, credit card expiration date, and billing address, will only be used to process the transactions requested.  This information will be provided to and maintained by an independent reputable credit reporting databases, but will never be sold, shared or provided to other third parties by SIAR. By using the E-Commerce Network to complete a transaction, users represent and warrant that they have the legal right to use any credit card(s) or other payment method(s) utilized in connection with any transaction and that they have authorized SIAR to charge the amount requested to the credit card or bank account provided. Users’ credit card or bank statement may reflect the name “NAR” or “SIAR” as the vendor for such transactions, and this name will appear on any transactions that are processed through our Website.

Intellectual Property. All materials contained on our Website are the property of SIAR. All rights, title and interest in each copy of every multiple listing compilation created and copyrighted by SIAR, and in the copyrights therein, shall at all times remain vested in SIAR. All trademarks, services marks, trade names, trade dress and logos appearing on our Website are the property of their respective owners. Reproduction, distribution, publication or transmission of copyrighted materials on our Website are prohibited without the express written consent of the copyright owner, unless otherwise specified. Further, no data content or information may be transmitted, retransmitted or provided in any manner to any unauthorized individual, office or firm, or otherwise used for commercial purposes unless expressly authorized in writing.

Personal and Non-Commercial Use Limitation. Users of our Website may only access, download and print materials on our Website strictly for personal and non-commercial use. SIAR does not guarantee the accuracy of all information on the Website and disclaims any responsibility for any inaccuracies. Each user agrees to hold SIAR harmless against any liability arising from any inaccuracy or inadequacy of the information on the Website. Users of our Website may not transmit, distribute, modify, copy, display, perform, reproduce, publish, create derivative works from, transfer, or sell any information, products, services or software obtained from our Website without our express written permission. SIAR may seek to enforce any and all rights afforded to it by law and preserve its rights, title and interest in the Website against users found to be in violation of this Policy.

Third Party Links. Our Website may contain links to external content. SIAR cannot assume responsibility for the privacy practices, page content or information for such third party sites. SIAR does not guarantee the accuracy, completeness, efficacy or timeliness of any information located on such third party sites. We would encourage our users to become familiar with the privacy practices and policies of any third party linked site prior to providing any information to such third party site.

Advertisements. Our Website may contain advertising. SIAR does not endorse (unless otherwise stated) and cannot assume any responsibility for the privacy practices of our advertisers. SIAR does not guarantee the accuracy, completeness, efficacy or timeliness of any information located on an advertiser’s website. As such, we would encourage our users to become informed of the privacy practices and policies of our advertisers prior to providing our advertisers with any information on their sites.

Children. Our Website is not targeted towards children. The Children’s Online Privacy Protection Act (COPPA) makes it illegal for any website to knowingly collect personal information from children under the age of 13 without receiving parental consent. As such, it is not our intent to collect personal data from children under the age of 13.

Policy Changes. We may make changes to this Policy to comply with necessary legal and regulatory requirements. We recommend our users review this Policy occasionally to familiarize themselves with any changes or alterations. A user’s continued use of our Website will constitute a user’s agreement to any changes made to this Policy.  

Choice of Law. The resolution of any disputes concerning this Policy are governed by the laws of the State of Indiana. The laws of the State of Indiana shall apply to all uses of the information and content on our Website. In the event that any of the provisions of this Policy shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, such provision shall be enforced to the fullest extent permissible and the remaining portion of this Policy shall remain in full force and effect.

Indemnification. Users agree to defend, hold harmless and indemnify SIAR from any and all claims, liabilities, damages, costs, expenses or attorneys’ fee arising from or related to use of the Website.

Disclaimer. The information contained in this Policy should not be construed as providing any legal, business, or other advice, or as warranting the security of the information users transmit through our Website. SIAR makes no representations or warranties, either express or implied, about the content or accuracy of information contained on our Website or the security of information transmitted by users via our Website and expressly disclaim the same.
